In 1958, moral philosophers were given rather startling advice. They were told that their subject was not worth pursuing further until they possessed an adequate philosophy of psychology. What is needed, they were told, is an enquiry into what type of characteristic a virtue is, and, furthermore, it was suggested that this question could be resolved in part by exploring the connection between what a man ought to do and what he needs : perhaps man needs certain things in order (...) to flourish, just as a plant needs water; and perhaps what men need are the virtues, courage, honesty, loyalty, etc. Thus, in telling a man that he ought to be honest, we should not be using any special sense of ought: a man ought to be honest just as a plant ought to be watered. This selection of D. H. Mellor's work demonstrates the wide ranging originality of his work. It gathers together sixteen major papers on related topics. Together they form a complete modern metaphysics. The first five papers are on aspects of the mind: on our 'selves', their supposed subjectivity and how we refer to them, on the nature of conscious belief and on computational and physicalist theories of the mind. The next five papers deal with dispositions, natural kinds, laws of nature and (...) how they involve natural necessity, universals and objective chances, and the relation between properties and predicates. Then follow three papers about the relations between time, change and causation, the nature of individual causes and effects and of the causal relation between them, and how causation depends on chance. This article is the text of an interview with D. H. Mellor conducted by Andrew Pyle and first published in the Spring 1993 issue of the philosophical journal Cogito.

This paper attacks two contrary views. One denies that nature has joints, taking the properties we call natural to be merely artefacts of our theories. The other accepts real natural properties but takes their naturalness to come by degrees. I argue that both are wrong: natural properties are real, and their naturalness no more comes by degrees than does the naturalness of the things that have them.1.

Mellor] Kant's claim that our knowledge of time is transcendental in his sense, while false of time itself, is true of tenses, i.e. of the locations of events and other temporal entities in McTaggart's A series. This fact can easily, and I think only, be explained by taking time itself to be real but tenseless. /// [J. R. Lucas] Mellor's argument from Kant fails. The difficulties in his first Antinomy are due to topological confusions, not the tensed nature (...) of time. Nor are McTaggart' s difficulties due to the tensed nature of time. The ego-centricity of tensed discourse is an essential feature of communication between selves, each of whom refers himself as 'I', and is required for talking about time as well as experience and agency. Arguments based on the Special Theory are misconceived. Some rest on a confused notion of 'topological simultaneity'. In the General Theory a cosmic time is defined, as also in quantum mechanics, where a natural present is defined by a unique hyperplane of collapse into eigen-ness. (shrink)

How can we distinguish one mind from another? How are we to determine what unifies the mind? Given radical mental disunity, these questions need to be answered.

Mind, Meaning, and Reality presents fifteen philosophical papers in which D. H. Mellor explores some of the most intriguing questions in philosophy. This is a study of the nature of time. In it, redeploying an argument first presented by McTaggart, the author argues that although time itself is real, tense is not. He accounts for the appearance of the reality of tense - our sense of the passage of time, and the fact that our experience occurs in the present - by showing how time is indispensable as a condition of action. Time itself is further analysed, and Dr Mellor gives answers to (...) most of the metaphysical questions it provokes, concerning the relation of time to space, the dissection of time, and its relation to change and causation. For years, the collection of DNA samples from individuals arrested for criminal misconduct has been advocated by police officials and endorsed by politicians. Louisiana, Virginia, California, and South Dakota have adopted laws to add DNA profiles derived from these samples to their DNA databases. Texas provides for DNA to be taken after indictment but before conviction. Although the U.S. Department of Justice initially shied away from the issue, the DNA Fingerprint Act of 20055 authorizes the collection of DNA from individuals (...) arrested for violations of certain federal criminal laws, and the inclusion in the national DNA database of all profiles from states that type DNA prior to conviction.But are these laws constitutional? In an article in a previous issue of this journal, and reprinted in this issue, Professor Tracey Maclin concludes that fidelity to precedent should lead the Supreme Court to strike down the Louisiana and Virginia laws as violations of the Fourth Amendment. Everything we do relies on causation. We eat and drink because this causes us to stay alive. Courts tell us who causes crimes, criminology tell us what causes people to commit them. D.H. Mellor shows us that to understand the world and our lives we must understand causation. _The Facts of Causation_, now available in paperback, is essential reading for students and for anyone interested in reading one of the ground-breaking theories in metaphysics. We cannot understand the world and our (...) place in it without understanding causation. Yet a complete account of the nature and implications of causation does not exist. In 2003, a photograph taken by Richard Prince, Untitled (Cowboy) , sold at auction for $332,300. Some might be surprised that a photograph could garner such a sum, but, in this case at least, none more so than Jim Krantz. Krantz might be allowed a certain level of incredulity, for Prince's photograph was a photograph of another photograph, this one taken by Krantz himself. As far as copyright is concerned, Krantz's photograph and Prince's are the same work, and so Krantz (...) is almost certainly infringing on Prince. Copyright protects ‘authored works’, and not art works per se . And unfortunately, while copyright law assumes some metaphysical basis to its objects, this basis tends to go largely uninvestigated. In this paper, I work to develop a comprehensive, coherent, and consistent account of the ontology of authored works suitable for the purposes of copyright law. (shrink)

How does the study of society relate to the study of the people it comprises? This longstanding question is partly one of method, but mainly one of fact, of how independent the objects of these two studies, societies and people, are. It is commonly put as a question of reduction, and I shall tackle it in that form: does sociology reduce in principle to individual psychology? I follow custom in calling the claim that it does ‘individualism’ and its denial ‘holism’.

Professor Monro presents an original view of ethics based on empiricism, which leads him to a subjectivist position about moral values. He starts by examining the central problem in moral philosophy: are moral statements objectively true, or are they expressions of preference? The first view conflicts with the empiricist beliefs current in modern thought; the opposing naturalistic theory seems to lead to moral scepticism. After discussing both views, the author presents a detailed defence of the subjectivist position. In the course (...) of his argument he gives a detailed analysis and criticism of the 'universalisability thesis', the theory that moral aspirations differ from others in being applicable to all men, and that it is this that makes them moral. He then offers an alternative account of the nature of moral attitudes. The author illustrates his explanations with straightforward analogies and examples. His clear exposition of the fundamental concepts arising in his argument makes this a book for students as well as for professional moral philosophers. (shrink)

On 9 August 1994 the German legislature revised the German Drug Law (AMG). Included in the revision is a passage requiring, for the first time, that the sponsors and investigators of clinical studies involving human subjects first obtain the approval of an ethics committee before carrying out such studies. According to the legislation, which takes effect on 17 August 1995, approval is to come from 'an independent ethics committee, set up and administered according to state law [emphasis added]' (1). Although (...) it is clear according to the text that the 16 federal states have been empowered to establish ethics committees within their jurisdictions, this does not mean that the state governments are free to transfer exclusive authority in the matter to their respective medical associations, a step that would effectively abolish Germany's private ethics committees. First, the legislation does not rule out the authorization of private ethics committees. Second, as legal scholars attest, the exclusive control of ethics committees by the medical associations would constitute an illegal monopoly. Third, it is arguable that medical-association ethics committees fail to meet the one prior federal requirement, that of independence. There is a great deal of confusion in Germany today about which kinds of ethics committees (public and/or private) the states will sanction before 17 August 1995. In an attempt to sort things out we present a brief explanation of how ther came to be two kinds of ethics committees in Germany, review the legal battle between the two over the issue of authorization, point out how the German legislature, in passing the recent bill, has missed an opportunity to clarify the issue and, finally suggest why the administration of ethics committees by the medical associations may be incompatible with the requirement that ethics committees be independent.
